Estate View Media Limited - Terms and Conditions

1. Definitions

Client: Refers to anyone who has placed a booking with Estate View Media Limited.

Service: Encompasses any product or service provided by Estate View Media Limited.

Working Hours: Estate View Media Limited's operational hours are indicated on Google or in email signatures.

Booking: Denotes any work instructed by the Client after receiving a confirmation email from Estate View Media Limited.

2. Preamble

Estate View Media Limited reserves the right to decline appointments if representatives feel unsafe.

Acceptance of these terms does not mandate a specific volume of bookings.

Using Estate View Media Limited's services binds the Client to the following terms.

Clients can make bookings on the Estate View Media Limited website with prepayment.

Credit accounts are open to UK-registered companies meeting certain requirements.

Terminating the business relationship with Estate View Media Limited only requires not booking further services.

Clients opening an account represent their company, and the account is owned by the registered company.

Estate View Media Limited may amend services or pricing, with prior notice to existing Clients.

3. Prices

All prices are exclusive of VAT and subject to change without notice.

Price agreements are non-contractual and can be adjusted.

4. Bookings

A booking fee secures the time slot, and its cancellation terms apply.

Canceling a booking at least 8 working hours before the appointment incurs no fee.

Late cancellations result in a booking fee charge even if rebooked or canceled.

Booking fees are 20% of work exceeding £250 (excluding VAT) or a fixed £50 fee for lower amounts.

Bookings are based on a first-come, first-served basis.

All bookings must be placed at least 4 hours before the start time.

Out-of-hours bookings may incur an extra 50% charge.

A confirmed booking requires a confirmation email, not just a verbal agreement.

Any changes must be communicated via email before confirmation.

The client must inform tenants/landlords when Estate View Media Limited meets them at the property.

Clear instructions are the Client's responsibility to prevent revisits.

Property access and readiness are the Client's responsibility.

Estate View Media Limited can collect/deliver keys within a 3-mile radius for free.

Delays exceeding 30 minutes due to access issues incur charges.

Clients are accountable for choosing the right services.

Unpaid invoices halt credit account use, requiring prepayment.

Overdue credit accounts allow job completion but withhold material until settled.

5. Downloadable Materials and Turnover

Clients must download and store materials provided by Estate View Media Limited.

Materials are archived for 60 days after the property visit.

Delivery timelines are subject to unforeseen factors.

Walkthrough videos are filmed using DSLR cameras, smartphones, and gimbals.

Videos are hosted on YouTube, and clients receive links.

Video length varies by property size and comes with background music.

6. Photography

Digital photographs and floor plans are provided within two working days.

Weather conditions or factors beyond Estate View Media Limited's control can affect results.

Editing includes specific adjustments.

Edited images are not exchangeable after completion.

Removal or photo manipulation incurs extra charges.

7. Floor Plans for Illustrative Purposes

Plans are approximations for illustrative purposes.

Estate View Media Limited is not liable for inaccurate measurements.

Measurements may be approximate or provided with disclaimers.

8. Measured House Surveys – Point Cloud

Data accuracy depends on hardware and weather conditions.

Plans drawn from Point Cloud are accurate.

Clients are responsible for providing certificates to impact EPC results.

Updates to lodged EPC based on certificates incur extra charges.

9. 3D Virtual Tours

Clients receive 3D virtual tours with a link for hosting.

Hosting is free for three months, with charges afterward.

Complimentary still images, promo videos, and 3D floor plans are provided.

Downloadable material is accessible for 60 days after the property visit.

Re-uploading the 3D tour incurs an admin fee if retrievable.

Virtual tours are represented by Estate View Media Limited, with customization at an extra charge.

10. General – Responsibilities/Liabilities

Services are not substitutes for structural surveys, valuations, or legal reports.

Estate View Media Limited disclaims responsibility for accidental property damage.

Heavy or large item lifting is not provided.

Keys are returned as per keyholder instructions.

Estate View Media Limited is not responsible for instruction legality.

11. Invoices

Invoices are sent monthly to credit account holders.

Payments must be made within 28 days or on an agreed Direct Debit date.

Late payments may result in discount removal, account suspension, and material withholding.

12. Copyrights

All material copyrights are retained by Estate View Media Limited.

Unauthorized material use breaches copyright and may incur penalties.

13. Complaints

Complaints must be sent to support@estateviewmedia.com.

Estate View Media Limited's formal complaint resolution procedure is outlined.

14. Ownership and Licensing of Content

Estate View Media Limited retains the copyright of all materials and content created during the provision of services. Upon full payment, clients are granted a license to use the content for marketing purposes related to their real estate business. However, clients are strictly prohibited from using the materials for any other purposes, such as resale or distribution.

15. Dispute Resolution

In the event of a dispute or complaint, clients are encouraged to first contact Estate View Media Limited's support team at support@estateviewmedia.com. Our formal complaint resolution procedure aims to provide a fair and transparent process to address any issues. If the resolution is not reached through this internal process, clients have the option to escalate the matter through a mediation or arbitration process, following the laws and regulations applicable to the jurisdiction.

16. Liability and Indemnification

Estate View Media Limited clarifies that the services provided should not be used as a structural survey report, valuation, or part thereof. Furthermore, while every effort is made to prevent damage during service provision, Estate View Media Limited is not liable for any accidental damage to the property, its contents, fixtures, or fittings caused by its representatives. Clients are responsible for ensuring that the property is ready for photography and that they have proper insurance to cover any potential damages or losses. Clients agree to indemnify and hold Estate View Media Limited harmless from any claims, liabilities, costs, and expenses related to the services provided.

17. Payment Terms

Clients with open accounts will receive invoices at the beginning of each calendar month for all the previous month's jobs. Payment is due within 28 days from the invoice receipt date or on an agreed Direct Debit date. Late payments may result in discount removal and account suspension, and any unpaid invoices may result in legal actions and additional charges.

18. Governing Law and Jurisdiction

In case of any legal disputes, these terms and conditions shall be governed by the laws and regulations of the jurisdiction in which Estate View Media Limited is registered. Any legal proceedings arising from these terms and conditions will be conducted within the jurisdiction where Estate View Media Limited operates, and clients agree to submit to the jurisdiction of the local courts or alternative dispute resolution mechanisms.

Refund Policy

At Estate View Media Limited, we strive to provide our clients with high-quality services and products. However, we understand that circumstances may arise where you may need to request a refund. This policy outlines our guidelines for refund requests.

19. Eligibility for Refunds

Refunds will be considered under the following conditions:

a. Service Non-Delivery: If we fail to deliver the agreed-upon services or products as outlined in the contract or agreement.

b. Quality Issues: If you are not satisfied with the quality of the services or products provided, and this dissatisfaction is due to a deficiency in our work, as determined by Estate View Media Limited.

c. Duplicate Payments: If you have been charged twice for the same service or product, you are eligible for a refund of the duplicated payment.

20. Refund Request Process

To request a refund, you must follow these steps:

a. Contact Support: In the event that you believe you are eligible for a refund, please contact our customer support team at support@estateviewmedia.com within 2 calendar days of receiving the services or products.

b. Explain the Issue: Clearly explain the reason for your refund request, providing all necessary details and evidence to support your claim.

c. Evaluation: Once your request is received, Estate View Media Limited will evaluate the request to determine its eligibility based on the conditions mentioned in section 19.

21. Refund Approval

If your refund request is approved, you will receive the refund through the same payment method used for the original transaction. The time it takes for the refund to process may vary depending on your financial institution.

22. Refund Denial

Estate View Media Limited reserves the right to deny a refund request if it does not meet the eligibility criteria outlined in Section 19. In such cases, you will be provided with a detailed explanation of the denial.

23. Cancellation Policy

For cancellation requests, clients are encouraged to contact our customer support team at support@estateviewmedia.com at least 1 calendar day prior to the scheduled service date. We will make every effort to accommodate your request, and if the service has not yet been provided, you may be eligible for a refund. Please refer to section 19 for eligibility criteria.

24. Updates to the Refund Policy

Estate View Media Limited reserves the right to make changes to this refund policy. Any updates or revisions will be communicated on our website and will be effective upon posting.

30. Copyright and Intellectual Property:

We respect the intellectual property rights of others and expect our clients to do the same. All content, including photographs, 3D tours, and other media produced by Estate View Media Limited is subject to copyright protection in accordance with UK copyright law.

31. Dispute Resolution:

In the event of a dispute, we aim to resolve issues amicably and in compliance with the UK's legal requirements. If an agreement cannot be reached, we will adhere to legal channels for dispute resolution as provided by UK law.

32. Changes in UK Law:

Estate View Media Limited reserves the right to modify its services and policies to ensure continued compliance with evolving UK laws and regulations. Clients will be notified of any significant changes.
